Wills The one thing in life which is certain is death. As a consequence we advise all our clients to consider the importance and benefit of making a Will. It is important and in many cases absolutely vital that you specify who you want to inherit your property when death occurs. Unmarried couples need to ensure that they have the right to remain living in their property if one of them dies. Making a Will can ensure the welfare and suitable upbringing of infant children. Making a Will can save thousands of pounds in Inheritance Tax. All our offices provide Will writing services to reflect individual circumstances and probably at a cost lower than you might expect. Probate Probate is the general term given to the legal process by which a deceased person’s property and money is dealt with either by the terms of that person’s Will or under the intestacy laws when no Will has been made. It can be a complicated and daunting process not made any easier with all the emotional upset that arises from a loved one’s death. It includes reporting to HM Revenue and Customs details of the deceased person’s wealth at the date of death and if appropriate the payment of any Inheritance Tax which may be payable to the government. It also includes obtaining confirmation from the Probate Court that a Will and an appointment of a personal representative is valid and from there the settlement of the deceased’s debts. Ultimately the estate can be distributed to the persons entitled to receive the property.
